Challenges to International Cooperation in Addressing War Crimes With Reference to the ongoing Conflicts in Ukraine and Gaza Strip

Abstract

Today, the commission of war crimes by different governments during the occurrence of armed conflicts has become a predictable phenomenon, the large volume of its destructive effects on human life hurts the conscience of the human society. Therefore, in recent decades, international jurists have sought to provide practical and appropriate solutions to minimize the occurrence of these crimes during various armed conflicts, and in this regard, they have succeeded in preparing and compiling specialized documents in this field, which forms the current international system that deals with these crimes. Therefore, the current research is trying to investigate the most important causes of the lack of accountability of the current system in dealing with these crimes by using library resources and applying analytical and descriptive methods, considering some of the most important international documents in this field. Finally, the findings of this research indicate that reasons such as the lack of a guarantee of proper implementation in these documents, the priority of international relations over international law for governments, the lack of membership of the world's top military powers in these documents, and the lack of use of political tools by others States against the offending states is one of the most important reasons for the weakness of the current international system in dealing with these crimes.
